BUILDING ENERGY STANDARDS

§ 54. Compliance plan
The Commissioner of Public Service:
(1) Shall issue a plan for achieving compliance with the energy standards adopted under
this subchapter no later than February 1, 2017 in at least 90 percent of new and renovated
residential and commercial building space. In preparing this plan, the Department
shall review enforcement mechanisms for building energy codes that have been adopted
in other jurisdictions and shall solicit the comments and recommendations of one or
more mortgage lenders; builders; building designers; architects; civil, mechanical,
and electrical engineers; utility representatives; environmental organizations; consumer
advocates; energy efficiency experts; the Attorney General; and other persons who
are potentially affected or have relevant expertise.
(2) May:
(A) Establish active training and enforcement programs to meet the energy standards adopted
under this subchapter.
(B) Establish a system for measuring the rate of compliance each year with the energy
standards adopted under this chapter. If such a system is established, the Commissioner
also shall provide for such annual measurement.
(C) Adopt administrative rules pursuant to 3 V.S.A. chapter 25 to implement this subdivision
(2). To the extent the implementation of this subdivision (2) places obligations on
persons outside the Department of Public Service, such obligations shall be by means
