Chapter 039 : Commercial Driver's License Act

  • § 4118. Effective date of disqualification; hearing

    (a) A disqualification from driving a commercial motor vehicle shall be effective on not less than 10 days’ notice.

    (b) If requested, a hearing on the disqualification shall be conducted under sections 105-107 of this title. Except as provided in subsection 4124(a) or 4124(c) of this chapter, the scope of the hearing shall be limited to verification of the conviction.

    (c) A person aggrieved by a decision resulting from a hearing under this section may have the decision reviewed on the record under Rule 75 of the Vermont Rules of Civil Procedure. The review shall be to the Washington Superior Court or, in the discretion of the licensee, to the Superior Court in the county the licensee resides or has a principal place of business.
