§ 9418e. Most favored nation clauses prohibited
Not later than 180 days after the effective date of this section, no contracting entity
shall do any of the following:
(1) offer to a provider, hospital, pharmacist, or pharmacy a health care contract that
includes a most favored nation clause;
(2) enter into a health care contract with a provider, hospital, pharmacist, or pharmacy
that includes a most favored nation clause; or
(3) amend an existing health care contract previously entered into with a provider, hospital,
pharmacist, or pharmacy to include a most favored nation clause. (Added 2009, No. 61, § 34; amended 2023, No. 6, § 234, eff. July 1, 2023.)
