§ 2177. Restraint by injunction; costs
When a prosecution is commenced for the violation of a provision of sections 2171, 2173, 2174, or 2176 of this title, the State’s Attorney may petition the presiding judge of the Superior Court to enjoin the carrying on of such unlawful business in the place where the complaint, information, or indictment charges that it has been conducted. Such presiding judge shall hear and determine such petition in the manner provided by law and the rules of civil procedure for the determination of causes and may, if the allegations therein are sustained, permanently enjoin the person, firm, or corporation shown to have kept or caused to have been kept such place, from conducting such prohibited business therein. The Superior Court or presiding judge may, upon petition therefor in such proceedings, issue a temporary injunction to effect, during the pendency of the petition, the closing of such place against such unlawful business. The costs of the proceedings authorized by this section shall be taxed against the defendant in case the State prevails. (Amended 1971, No. 185 (Adj. Sess.), § 236, eff.
