§ 734. Supervisors may petition Superior Court
If a landowner does not sign such stipulation, the supervisors may petition the Superior
Court to require such landowner to bring his or her land into conformity with the
ordinance, and the court shall order such relief as it may deem necessary in the interest
of public health, safety, and welfare. However, no landowner shall by ordinance or
otherwise be required to pay any money or perform any act that shall not be for the
protection of his or her own land nor shall he or she be required to pay any money,
perform any act, or carry out any practice that shall not be in just proportion to
the benefits that he or she will receive and further provided that he or she shall
not be required to pay any money, perform any act, or carry out any practice that
