§ 2—108. Miscellaneous health provisions; blood or tissue transfer services
The procurement, processing, distribution or use of whole blood, plasma, blood products
or blood derivatives for the purpose of injecting or transfusing any of them into
the human body shall be construed, for all purposes, as the rendition of a service
by every person participating therein and, whether or not any remuneration is paid
therefor, shall not be construed as a sale of such whole blood, plasma, blood products
or blood derivatives for any purpose whatsoever. The use of any part of a body including
organs, tissues, eyes, bones, arteries, blood, other fluids and any other portions
of the human body for the purpose of transplantation in the human body shall be construed
for all purposes as a rendition of a service by each and every person participating
therein and, whether or not remuneration is paid therefor, shall not be construed
as a sale of such part for any purpose whatsoever. (Added 1989, No. 273 (Adj. Sess.), § 11, eff. June 21, 1990.)
