§ 3849. Adoption of rules
The Commissioner may:
(1) Adopt rules necessary to carry out the purposes of this subchapter.
(2) Establish standards for evaluating reasonableness of payments under life settlement
contracts for persons who are terminally or chronically ill. This authority includes
the regulation of discount rates used to determine the amount paid in exchange for
assignment, transfer, sale, devise, or bequest of a benefit under a life insurance
policy insuring the life of a person who is chronically or terminally ill.
(3) Adopt rules governing the relationships and responsibilities of insurers, life settlement
providers, and life settlement brokers during life settlement transaction. (Added 2009, No. 53, § 1, eff. Jan. 1, 2010.)
